Do Motorcyclists in TX Have to Wear a Helmet?
You may not want to wear a motorcycle helmet, but is it the law?
When Texans ride their motorcycles, they want to look cool. It is hard to look cool when you are wearing a funky-looking helmet that covers your entire head, so many riders just do not wear one.
There is no denying that a helmet can protect your head in the event of a motorcycle crash. Many riders have died from brain damage and other head trauma because they did not wear a helmet.
While wearing a helmet may be the safest option, is it necessary in Texas? Are you breaking the law if you do not wear a helmet? It depends on your age. Read on to learn more.
Texas Helmet Law
Every state has its own rules when it comes to helmet use. Texas does have a helmet law, to some degree. Only those aged 20 and younger are required to wear a helmet. This law applies to drivers and passengers and all motorcycle-type vehicles (two-wheeled vehicles, three-wheeled vehicles, mopeds, etc.).
If you are age 21 or older, you do not have to wear a helmet if you meet one of these requirements:
- You have completed an approved motorcycle operator training course.
- You have at least $10,000 in medical insurance coverage to pay for any injuries in an accident.
However, the law is iffy. That is because there is a loophole in state law that makes it so police cannot stop a motorcyclist who is riding without a helmet. There have been several proposals that would close this motorcycle helmet loophole, but the governor refuses to sign such legislation.
So regardless of whether you are under 21 or meet the insurance or training requirements, police cannot cite you for the non-use of a helmet. It is pretty much up to you if you want to wear a helmet or not.
Should You Wear a Helmet?
Should you wear a helmet while riding a motorcycle? Ultimately, it is a personal decision, but evidence shows that it is definitely recommended. Many people have survived accidents by wearing a helmet. In fact, studies have shown that motorcycle helmets reduce the risk of head injury by 69% and reduce the risk of death by 42%.
Wearing a helmet reduces your risk of serious brain injury and death because, in a crash, most of the impact energy is absorbed by the helmet rather than your head and brain. If you do decide to wear a helmet, make sure you wear the right one. It should fit properly and offer sufficient cushioning to provide the level of protection you need.
